The statement of claim was inscrutable, embarrassing and failed to plead a tenable cause of action against the first defendant. The defamation claim did not plead publication by the first defendant, appeared to be statute-barred, and did not comply with the pleading requirements for defamation; the malicious prosecution and conspiracy claims were misconceived attempts to impose liability on the first defendant for alleged conduct of others and also appeared statute-barred. The proposed amended statement of claim did not cure those defects. The same difficulties precluded prosecution of the claim against the second defendant, and scandalous content warranted sealing of the statement of claim.
