The Tribunal found, on the balance of probabilities, that Mr Zielke and Mr Favell each engaged in unwelcome conduct of a sexual nature towards Ms Carroll in circumstances where a reasonable person would have anticipated Ms Carroll would be offended, humiliated, or intimidated, constituting unlawful sexual harassment under the Anti-Discrimination Act 1977. The employer, Zielke Investments, was also liable as it failed to take reasonable steps to prevent such conduct. Damages were apportioned 20/80 between Mr Favell and Mr Zielke, with the employer jointly and severally liable.
