The court held that, notwithstanding dismissal of the applicant's proceedings to set aside the judgment, the institution of both those proceedings and the application to set aside the bankruptcy notice itself enlivened the discretion to extend time under s 41(6A). Further, the issue of potential non-compliance with the Family Law Rules by the judgment creditor in recovering legal costs warranted further examination at the hearing to set aside the bankruptcy notice. Accordingly, time for compliance with the bankruptcy notice was extended until determination of the application to set aside the notice.
