Although the amended proposal complied numerically with the maximum height and FSR controls, the additional 70m² rooftop storage area producing a third-floor area of about 82m² was not sufficiently justified, would further increase the visual prominence of an already uncharacteristic building, failed to meet key LEP and DCP objectives concerning visual relationship, character and amenity, and would cause unjustified additional outlook and overshadowing impacts to the western neighbour. The modification application was therefore refused.
