The Full Court dismissed the appeal because the grounds either sought factual findings that could not be made on an appeal limited to questions of law or failed to show any error by North J. On the facts found by the Tribunal, the Tribunal had given the appellant a reasonable opportunity to present his case and had afforded procedural fairness. There was no basis to overturn the Tribunal's discretionary decision to proceed in the appellant's absence under s 40(1)(b) of the Administrative Appeals Tribunal Act 1975 (Cth).
