Ratio Decidendi

Felicity Cassegrain's title was defeasible under the fraud exception to s 42 Real Property Act 1900 (NSW) because the fraud of her husband, Claude Cassegrain, was imputed to her by agency and joint tenancy principles. As a consequence, Gerard Cassegrain & Co Pty Limited is entitled to orders for recovery of the property under s 118(1)(d); Felicity holds the property on trust for GC & Co and must transfer it back. Her failure to adduce evidence enabled the inference that Claude acted as her agent, and the principles applying to joint tenants mean both were affected by Claude's fraud.
