Ratio Decidendi

The Tribunal found that the Respondent, through its agent, made false and misleading representations to the Applicant about exclusivity of menu items, non-renewal of a competing lease, and refurbishment plans, which induced the Applicant to enter into the lease. These statements were made with knowledge of their falsity. As such, the Respondent is liable under s 10(1) of the Retail Leases Act 1994 to pay reasonable compensation for damages suffered, assessed as set-up costs and wages liability, less accumulated profit.

Orders
