Ratio Decidendi

Although the adverse findings concerning the CTTT order, false declaration and fitness were not made out, the applicant did not meet the current qualification requirements determined by the Commissioner for the Building contractor licence. His former licences had expired more than two years before the new application, so he could not rely on the transitional acceptance of a previous licence, and the Tribunal could not review the standards set by the Commissioner. The application therefore had to be refused and the correct and preferable decision was to affirm the determination.
