The Public Trustee owed statutory and common law duties to administer the intestate estate and hold or distribute its assets for the persons entitled. By placing the estate in abeyance, failing to seek a next of kin inquiry or judicial advice, failing for decades to distribute the estate, and ceasing to retain control of the estate assets, the Public Trustee breached its statutory duty and duty of care. The Plaintiff was entitled to a one eighth share of the estate with compound interest to 30 June 2008, exemplary damages for the Public Trustee's contumelious disregard of his rights, and indemnity costs, with the Defendant personally liable apart from the Plaintiff's estate share.
