Mr Cullen had authority to negotiate and accept a deal on Mr Thiele's behalf, and he accepted the $1300 cheque in circumstances where Trustech reasonably understood the payment to settle the dispute and end the court proceedings. Mr Thiele then banked the cheque. The settlement agreement therefore came into being and Trustech was entitled to rely on it as a full defence to the application.
