Although the termination was not validly based on redundancy, Mr Toliopoulos's serious misconduct before cessation justified dismissal. Therefore, no relief or compensation should be granted as his entitlement was nullified by that conduct. Alternatively, any monetary loss was so minimal that no compensation is appropriate.
