Harrisa v Puksand [2002] NSWSC 360
The undisputed February conversation and absence of evidence of a contractual relationship authorising the final Volvo showroom work made it fairly clear that the plaintiff had denied liability for that work and that Volvo Australia had authorised it. The monies paid for that work were at least arguably paid under a mistake of fact and recoverable, so the plaintiff's offsetting claim was not frivolous or vexatious and the statutory demand should be set aside.
