Harvard Nominees Pty Ltd v Tiller [2019] FCA 1672
The majority of the subpoenas were too wide as they referred to a range of entities not sufficiently confined to the issues relevant to the proceedings, or lacked appropriate time limitations. While the alleged involvement of Mr Nicoletti in Dimension and the Farms is squarely in issue, and documents relevant to that issue serve a legitimate forensic purpose, the subpoenas as drafted extended to documents beyond what was necessary, particularly those relating to entities not linked to the Farms. As such, subpoenas that were overbroad or ambiguous were set aside, but leave was given to issue more confined subpoenas. The subpoena to NAB was not overbroad and was not set aside.
