The majority held that the relevant provisions of the Business Franchise (Petroleum) Act, 1974-1975 S.A. do not impose a duty of excise for the purposes of s. 90 of the Constitution, because the licence fees are calculated on sales for a past period and are not taxes on goods as such. Further, the Act does not impermissibly burden interstate trade or commerce contrary to s. 92. Even if impairment could be found in relation to interstate trade, the invalid provisions could be severed or the Act read down to permit operation in relation only to intrastate activities. Accordingly, the Act was held to be valid and the demurrer was allowed.
