The sentencing judge erred by not taking into account the utilitarian value of the applicant's plea of guilty as required by s 16A(2)(g) of the Crimes Act 1914 (Cth) in light of Xiao v R. Additionally, a separate discount for assistance to authorities should be applied under s 16A(2)(h). The appeal is allowed and the applicant is resentenced accordingly.
