Ratio Decidendi

The appeal was allowed because the trial judge misapplied the test for granting leave to proceed out of time by giving inappropriate weight to the plaintiff's blamelessness and failing to properly address whether a fair trial could now be held. The evidence showed that due to the delay, it was now impossible to fairly distinguish between injuries caused by the work accident and those caused by the motor vehicle accident, resulting in material prejudice to the appellant and making a fair trial unlikely. Therefore, the leave to commence proceedings out of time should not have been granted.
