Although the employer had operational reasons for contracting out maintenance, the summary dismissal of the applicant without offering alternative employment or training was harsh, unjust and unreasonable, in contravention of s.170DE(2) of the Act and relevant award provisions. The applicant is entitled to reinstatement subject to repayment of the redundancy payment, with lost wages to be compensated less sums earned, and set-off between parties.
