Sprayworx Pty Ltd v Homag Australia Pty Ltd [2016] NSWSC 51
The affidavits should not be excluded merely because Messrs Duwentäster and Bauersfeld were involved in the events and may have views adverse to Sprayworx. Mr Bauersfeld's opinion was limited to the value of Sprayworx's expert's inspection-based opinion, and alleged partiality was not intimately concerned with that issue. Mr Duwentäster's factual involvement and technical opinions could be distinguished, and any asserted infection of the latter by the former could be tested in cross-examination. The material did not show that his technical opinions were so compromised that all of his evidence should be rejected, and excluding his factual evidence would significantly prejudice Homag.
