There is a serious question to be tried whether poker machine entitlements are partnership property and whether the defendants are under a fiduciary obligation to act for the benefit of the partnership. Damages would ordinarily be an adequate remedy, but in view of possible hardship and balance of convenience strongly favouring the plaintiff, maintenance of the status quo by injunction is appropriate pending final determination.
