Ratio Decidendi

The reproduction by IceTV of time and title information from the Aggregated Guides for inclusion in its electronic programme guide was not a reproduction of a substantial part of the original literary works (the Weekly Schedules or the Nine Database) within the meaning of the Copyright Act 1968 (Cth). The originality in the Weekly Schedules lay in the selection, arrangement, and inclusion of creative elements (such as synopses), whereas the form of expression for the time and title information was dictated by the nature of the information and lacked sufficient originality. Therefore, no infringement occurred.

Court Disposition

Appeal allowed with costs.

Orders

  • Set aside the order of the Full Court of the Federal Court of Australia made on 8 May 2008, as varied on 20 August 2008.
  • Order that the appeal to that Court be dismissed with costs.
