Procedural Posture

Retail Tenancy Claim in the Consumer and Commercial Division Concerning a Former Retail Shop Lease / Final Determination After Hearing

  1. 1 ['Whether the Tribunal has jurisdiction to hear and determine the proceedings.' 'Whether Mr Jbarat converted the goods and fixtures of Impressive and, if so, what loss was suffered by Impressive.' 'Whether Mr Jbarat breached the lease and, if so, what loss was suffered by Impressive.']

Ratio Decidendi

The Tribunal had jurisdiction because the parties were former parties to a former retail shop lease and the claim was a retail tenancy claim lodged within time. Impressive did not prove ownership of the fixed items claimed as disputed equipment and did not prove that Mr Jbarat was responsible for missing items it owned, so the conversion claim failed. Although Mr Jbarat breached the lease by not permitting Impressive to remove its goods shortly after 29 September 2021, Impressive did not prove that the breach caused any loss. The proceedings were therefore dismissed.
