The executors of the deceased sole director could not sustain the application in that capacity because the director's office was vacated on death and they had not appointed a replacement director under s 201F(2). In light of Treadtel International Pty Ltd v Cocco and s 459P(5), the Court could not proceed on an application by persons lacking statutory standing. However, Alpha Consulting Group (Norwest) Pty Ltd was a creditor with standing under s 459P, and the evidence established that the Company was insolvent; accordingly, a winding up order in insolvency should be made.
