Ratio Decidendi

The plaintiff's endeavours were not an effective cause of Meriton's 2002 acquisition of the Sundale property. The Court accepted that Meriton had some dealings after the plaintiff's June 2000 approach, but found that the plaintiff did not change Mr Triguboff's attitude to buying the site, that Meriton did not want to buy it as at 30 August 2000, and that the purchase in 2002 resulted from changed market perceptions, changes to the development approval, and the substantial work of others, particularly Mr Pearsall. Accordingly the commission condition was not satisfied.

Court Disposition

Summons dismissed.
