Ratio Decidendi

Burchett J did not deny procedural fairness because he granted the only relief available on the s 44 appeal, namely setting aside the Tribunal's dismissal of Mr Guse's application and remitting the matter to the Tribunal. The Federal Court had no jurisdiction in that appeal to determine Mr Guse's broader grievances or grant damages or compensation assessment orders. The remittal merely returned the proceedings to the Tribunal to continue the hearing prematurely ended by the dismissal and was not inconsistent with Einfeld J's earlier order. The remaining grounds misunderstood the Tribunal's review function and disclosed no error by Burchett J.
