The proposed roof-level additions would cause unreasonable loss of harbour and water views to several apartments at 85 Drumalbyn Road, especially Unit 2, with the position of the floor space ratio exceedance contributing to that view loss. Applying the relevant WLEP and Residential Development Control Plan provisions and the view loss principles in Tenacity Consulting v Warringah and CSA Architects P/L v Woollahra, the view loss exceeded any reasonable view loss even though the views were across an adjoining property, and was fatal to the appeal.
