The Tribunal erred by resolving evidentiary conflicts and making factual findings at stage 3 of the Deledio analysis when deciding whether the applicant's hypothesis was reasonable under s 120(3). There was evidence capable of supporting the necessary elements of the hypothesis, and disputed issues about stressors and alcohol consumption could not be decided against the applicant at that stage. The Tribunal also erred, alternatively, because its reasons did not show that it considered the range of potentially applicable causation criteria in s 196B(14), including criteria more favourable than a 'but for' or unexplained 'operative cause' test.
