Although the plaintiff is an eligible person and has marginal financial circumstances, the estate is insufficient to satisfy the deceased's primary obligation to provide for the maintenance of his widow. Given the primacy of this obligation, and in light of the plaintiff's ability to support himself and potential support from his mother and stepfather, a wise and just testator would not have made provision for him. Consequently, the plaintiff was not left without adequate provision.
