Hutchins v Wily [1999] NSWSC 780

The plaintiff's application under section 503 could proceed only if she was a creditor or contributory of the fifth defendant. She did not contend that she was a contributory, and there was no evidence that she was a creditor: she had lodged no proof of debt and the bank statement showing a $5030 withdrawal did not connect the withdrawal with the fifth defendant. The first defendant was therefore entitled to have the proceedings against him dismissed.
