On an objective analysis, taking into account all the relevant facts adduced at trial and in the context of the principles under the Costs in Criminal Cases Act 1967, it would not have been reasonable to institute the proceedings against the applicant had all such facts been known to the prosecution prior to charging. The credibility of the complainant's account was substantially undermined, there was a lack of supporting objective evidence for non-consensual intercourse, the applicant's conduct and character evidence supported innocence, and the overall evidentiary picture did not support the reasonableness of prosecution.

Costs certificate issued in favour of the applicant.
