The commencement of proceedings to recover damages in contravention of s 151C by the appellant was not an effective election for the purposes of s 151A because, at the relevant time, he was not a person entitled to commence such proceedings. Sections 151A and 151C operate together such that the statutory election arises only by commencing proceedings that one is entitled to commence. Accordingly, the appellant is not precluded from claiming permanent lump sum compensation.
