The Court upheld the appeal because, although the excavation in sand beneath a Victorian terrace posed an unacceptable risk if subject only to normal controls, the expert evidence showed that onerous consent conditions requiring careful design, verification, certification and construction controls could reduce the risk of damage to a minimal level of about 1%. Together with the development application reports, those conditions provided sufficient certainty that the excavation could be undertaken consistently with cl 18 and the objectives of Woollahra Local Environmental Plan 1995, and the amenity, traffic, public safety and heritage impacts were acceptable.
