Although the respondent had not been as diligent as he should have been, it was reasonable and consistent with the guiding principle to permit preliminary acoustic testing so the respondent was not compelled to adopt a more expensive solution to avoid the risk of failing the 5 star requirement. The applicants were therefore required to permit access on at least seven days written notice, and the time for compliance with the 12 October 2023 orders was extended by two months.
