Ratio Decidendi

The Owners Corporation unreasonably refused to approve a by-law for lot 1's exclusive use of garage 1, which mirrored by-laws for lots 7 and 8. Failure to approve the by-law on two occasions, despite majority support, was unreasonable. The applicant is entitled to an order under s.158 for the granting of the by-law. The application for appointment of a strata manager is dismissed as statutory requirements (written consent of appointee) were not satisfied, notwithstanding evidence of management dysfunction. The application to invalidate a 2016 resolution is dismissed as it was not properly incorporated into the application nor procedurally compliant.
