The Valuer General's valuation was excessive because, although the Court relied on Mr Austin's expert comparable-sales evidence, it accepted that aspects of the adjustment analysis were unclear or erroneous and, after its own assessment of comparable sales and relevant factors, determined that the appropriate land value as at 1 July 2004 was $400,000. The adjoining 5A Silver Strand Circle transaction was not used as a primary comparable sale because of the circumstances of the business-partner buyout, but it provided a useful check on the valuation outcome.
