The appeal was dismissed because, despite evidence questioning some flood modelling and despite council's inconsistent decision making, the subject land remained classified in the Wingham Peninsula Floodplain Management Plan as high hazard floodway. The Court could not reclassify the land, and approval of a dwelling in that area would be contrary to the relevant planning framework and not in the public interest because of risks to human life and rescuers, particularly in the absence of a satisfactory emergency evacuation plan.
