The plaintiffs have each been in adverse possession of the relevant part of the disputed strip for a period exceeding 12 years; there is no evidence of public acceptance or use of the strip as a public road. Therefore, the previous title has been extinguished under s 31 of the Limitation of Actions (Real Property) Act 1988 (NI) and the plaintiffs are entitled to declarations that they hold title to the respective portions of the land in question.
