Procedural Posture

Appeal / Judgment on Appeal From Administrative Appeals Tribunal

  1. 1 Meaning and method of determining 'nearest other premises' under relocation rules for pharmacies pursuant to s 90 and s 99L of the National Health Act 1953 (Cth)
  2. 2 Whether the same meaning is to be given to 'nearest other premises' in rule 6(b)(i) and 6(b)(ii)

Ratio Decidendi

The phrase 'nearest other premises' in rule 6(b) of the applicable Ministerial rules under the National Health Act 1953 (Cth) must be construed in context: in subrule 6(b)(i) it is the premises nearest by straight line measurement; in subrule 6(b)(ii) it is the premises nearest by lawful access measurement. Each limb operates independently, and both must be satisfied for approval of a pharmacy relocation. The applicant's approach would lead to results inconsistent with the policy and purpose of the rules.
