The court held that the defendant failed to establish that its conduct in publishing the defamatory imputations was reasonable as required for qualified privilege, primarily due to the identification of the plaintiff without giving him an opportunity to respond. The defence of contextual truth was rejected because the substantially true contextual imputations (illegal backburn in dangerous circumstances) were not of equal or greater gravity than the defamatory imputations, which included wrecking fire strategy. All interstate and alternative defences likewise failed. The plaintiff was awarded damages for harm to his reputation.
