The plaintiff signed the transfer documents without independent advice and without the documents being read or explained, because of the defendant's instruction. The defendant failed to show that he took no advantage of the plaintiff, and his reliance on the transfer was both undue influence and unconscionable conduct. Equity therefore required that the defendant hold the property on constructive trust for himself and the plaintiff as tenants in common in equal shares.
