The offence was purely technical and trivial: although the appellant failed to stop at a red traffic control light while riding a bicycle, he endangered no one, caused no risk to vehicular or pedestrian traffic, acted to avoid inconveniencing pedestrians, had no prior traffic conviction while in charge of a bicycle, and had prior good character. It was therefore appropriate to set aside the Local Court conviction and dismiss the charge under s 10.
