Chung-Yi Pty Limited was entitled to recover all of its costs of the proceedings from the defendant, as the claims were closely intertwined and could not meaningfully be severed for costs purposes. The individual plaintiffs were not entitled to recover costs incurred uniquely for their claims, as their claims failed, but the defendant was not awarded costs against them. Indemnity costs were refused because, although the defendant fabricated evidence, the complexity and costliness of the case would have persisted regardless, due to inadequacies in financial records and the manner in which the company’s affairs were run.
