Given the appellant's impecuniosity and that substantial costs will be incurred by respondents regardless of the narrowed appeal, the circumstances do not warrant reduction or removal of the security for costs requirement. The appellant is permitted a defined time to provide security for costs, failing which the proceeding will be dismissed as against the relevant respondents.

Orders

  • The security for costs ordered by French J on 15 October 2004 is to be provided by 4pm on Friday 5 May 2006.
  • If the appellant fails to provide security for the first respondent by the deadline, the proceeding is dismissed as against the first respondent; similarly for the second and third respondents.
