Wentworth v Rogers [2009] NSWSC 1038
Bankruptcy Act 1966 (Cth) operates to prohibit Ms Wentworth from enforcing her judgment debt against Mr Rogers outside the procedures specified in that Act once Rogers became bankrupt. The assets vested in the Official Receiver, and pre-bankruptcy debts (for damages and costs) became provable debts to be dealt with under the federal statute. Accordingly, the present enforcement proceedings and related subpoenas cannot continue.
