The revised proposal, incorporating further setbacks and landscaping suggested by the Court-appointed expert, satisfied cl 14 of the North Sydney Local Environmental Plan 2001 and was consistent with cl 49. On the expert evidence, strict adherence to the landscape area and building height plane standards was unreasonable and unnecessary, and demolition of the existing garage and construction of the amended garage would not cause incremental loss of heritage significance or unacceptable impact on the rear lane conservation area context. Consent orders approving the development application were therefore granted, with an additional condition concerning stepping stones and permeability.
