Leave and an extension of time were refused because the defendant gave no explanation for the delay or for why the evidence was not included in his detailed November 2020 statement, the new material was not required by recent amendments to the statement of claim, the adequacy of pre-surgery advice had always been an obvious issue, and admitting the statement after the plaintiff had already been partly cross-examined would create unfairness and prejudice that could not be cured by costs or adjournment and could derail or delay the resumed hearing.
