The defendant did not establish on the balance of probabilities that he was unfit to be tried or that a fair trial could not be held. On a careful reading of Dr Westmore's report, the defendant understood the charge, the nature of the proceedings and had a version of events about which he could instruct counsel. Cognitive difficulties, fading memory and some impairment in providing clear and consistent instructions were insufficient to satisfy the Presser test, particularly where practical allowances such as extra time, breaks and cautious cross-examination could be made.
