The Land and Environment Court had no power to make an order against Blakehurst requiring it to remedy a breach of the Local Government Act 1993 for which it was not legally responsible. Once the land was transferred and registered in Blakehurst's name, it ceased to be 'community land' under the Act, and the registration conferred an indefeasible title on Blakehurst, even if the transfer itself was void or in breach of the statute. Thus, orders requiring retransfer could not stand.
