The Council's challenge on nuisance failed because, even if it was not the occupier of the road, its management position was analogous to occupation and, in any event, it had repeatedly conceded responsibility for the continuing nuisance and could not now deny it. The liberty to apply challenge also failed because the consent orders were not understood by the parties or the Court as finally disposing of the flooding dispute, so Sperling J applied the correct principles in dealing with further relief. The appeal was dismissed with costs.
