Leave to file the review application out of time was refused because the Court was not positively satisfied that the time limit should be extended: there was no acceptable explanation for the delay, the respondent's affidavit evidence was contradicted by her oral evidence and her credibility was rejected, the applicant suffered substantial prejudice from being kept out of compensation and having to take enforcement steps, the proposed review had no more than arguable merit, and fairness considerations weighed against encouraging dilatory conduct or ignoring Court notices.
