The Applicant had resigned from his employment as a Night Filler or Freezer Clerk and thereafter performed home deliveries under a contract. On the oral and documentary evidence, including the Applicant's admissions and the contractual terms, the relationship at the relevant time was one of independent contractor and principal, not employer and employee. The unlawful termination application therefore lacked jurisdiction and was dismissed.
